These Terms & Conditions (“Terms”) apply to purchases made through lauraavery.com (the “Website”), operated by LAURA AVERY, SIREN 943 375 865 (“I”, “me” or “the Artist”).

By submitting an inquiry or placing an order through the Website, you confirm that you have read and accepted these Terms.

1. Orders

Products available for purchase are subject to availability. An order is placed when you complete the checkout process and payment has been successfully received. Once an order has been placed, you will receive confirmation by email. I reserve the right to refuse or cancel an order where there is a genuine issue concerning availability, pricing, payment or other circumstances that prevent the order from being fulfilled. If payment has already been made, the relevant amount will be refunded.

2. Prices and payment

All prices displayed on the Website are in euros (€). Shipping costs are not included in the displayed artwork price unless expressly stated otherwise. Applicable shipping costs are calculated and displayed during checkout. Payment is processed securely through Stripe. I do not have access to or store your full payment card details. Where applicable, taxes, duties or other charges associated with an international purchase are handled in accordance with the applicable laws and regulations. Where the French VAT franchise applies, invoices will include the legally required wording “TVA non applicable – article 293 B du CGI.” The applicable tax treatment may vary depending on the nature and destination of the transaction.

3. Shipping and delivery

I ship original artworks and prints to destinations where shipping is available. Shipping costs are calculated at checkout and are paid by the buyer. Orders are prepared for dispatch as soon as reasonably possible. Depending on the artwork, destination and carrier, delivery may take up to six weeks. Any estimated delivery timeframe provided is indicative and may be affected by circumstances outside my control, including carrier delays, customs procedures or other international shipping issues. For international orders, the buyer is responsible for any customs duties, import taxes, VAT or other charges imposed by the destination country. Once an order has been dispatched, tracking information will be provided where available.

5. Delivery issues and damaged artwork

If your artwork or print arrives damaged, please contact me as soon as reasonably possible at its.lauraavery@gmail.com and provide photographs of the packaging and artwork. I will assess the circumstances and work with you to determine an appropriate solution. This process does not limit any statutory rights or legal remedies available to you under applicable consumer law.

6. Custom artwork

Commissioned artworks are created according to the terms agreed between the Artist and the client. A separate commission agreement will govern the individual project, including its creative scope, price, payment schedule, timeline, delivery arrangements and any applicable usage or licensing rights. Unless expressly agreed otherwise, copyright and intellectual property rights in commissioned artwork remain with the Artist.

Upon approval of the sketch, a 50% down payment is required. The remaining amount must be paid before delivery. If payment is not received on time, Laura Avery has the right to suspend delivery until full payment has been made. The lead time averages 4–8 weeks, depending on size and complexity. The stated delivery time is indicative. Exceeding this does not entitle the client to compensation or termination of the agreement, unless otherwise agreed in writing.

7. Cancellation

For purchases made online by consumers within the European Union, a statutory 14-day right of withdrawal generally applies to purchases of goods.For an artwork or print, the withdrawal period begins on the day after the consumer, or a third party designated by the consumer, receives the goods. If you exercise your right of withdrawal within the applicable period, you must inform me clearly of your decision to withdraw by contacting: its.lauraavery@gmail.com to be informed of the following steps and limitations.

Exception for Custom Work

In the event of cancellation after approval of the sketch, the deposit is non-refundable. Custom-made paintings are created according to the client's specifications and are therefore considered personalised goods. Pursuant to Article L221-28, 3° of the French Consumer Code (Code de la consommation), the statutory right of withdrawal does not apply to such works.

8. Legal guarantees

Nothing in these Terms limits or excludes any statutory consumer rights. Where applicable, consumers benefit from the legal guarantee of conformity and the legal guarantee against hidden defects (vices cachés) provided by French law. The legal guarantee of conformity generally applies for two years from delivery of the goods. If you believe that an artwork or print is defective or does not conform to the order, please contact its.lauraavery@gmail.com with details of the issue and, where relevant, photographs.

9. Intellectual property and copyright

All artworks, designs, images, photographs, written content and other creative materials displayed on the Website remain the intellectual property of LAURA AVERY or their respective rights holders. The purchase of an original artwork or print does not transfer copyright or reproduction rights to the buyer. Unless expressly agreed otherwise in writing, you may not reproduce, copy, scan, photograph for commercial reproduction, distribute, modify, license, sell as a reproduction or otherwise commercially exploit an artwork or image without my prior written permission. Ownership of a physical artwork is transferred to the buyer upon completion of the purchase, but copyright and intellectual property rights remain with the Artist. Limited-edition prints may not be reproduced or used to create further reproductions.

10. Personal data

Personal data collected through the Website is processed in accordance with the Website's Privacy Policy. Please refer to the Privacy Policy for information about the data collected, the purposes for which it is used, third-party service providers and your rights under applicable data protection law.

11. Liability

Laura Avery is not liable for damage caused by improper use of a delivered work. The liability of Laura Avery is limited to the amount of the relevant agreement, unless there is intent or willful recklessness.

12. Complaints

13. Applicable Law

These Terms are governed by French law.

Where the customer is a consumer residing in another country of the European Union, mandatory consumer protection provisions applicable in that country remain unaffected. In the event of a dispute, the parties will first seek to resolve the matter amicably. Where an amicable resolution cannot be reached, any dispute will be dealt with by the competent courts in accordance with applicable French and European consumer law.
